Squatters have rights too but without a contract in place with the property owner you will find evicting squatters is a much more contentious area. Squatter Eviction Process

  • Legal 4 Landlords will urgently draft proceedings, take a witness statement, and issue proceedings at court, with an early hearing date set usually within 14 days. Once the hearing is obtained, we will also arrange for papers to be served on the squatters, an advocate will attend the hearing to obtain a possession order and for the order to be served on the squatters. Once a possession order has been obtained, the squatters need to be evicted. For speed we arrange for High Court Sheriffs to set down an urgent eviction date, which takes a further 7 days (approximately). This is all included in the fixed fee service.

  • For a fixed fee we will work with High Court Sheriffs to evict the squatters. To avoid a delay with the county court arranging bailiffs to evict squatters, which can take several weeks, we arrange High Court Sheriffs to enforce the possession order.

    Squatter Option One: What happens next ?

    STEP 1

    Complete the simple online form with payment. One of our eviction experts will contact you within 2 hours

    STEP 2

    The relevant notices will be served on the Squatter(s) within seven days

    STEP 3

    An Interim Possession Order is generally granted and served upon the Squatters

    STEP 4

    The Squatter leaves If not then we move onto Eviction Step Two.

    Squatter Option Two: What happens next ?

    STEP 1

    If the squatters have not left, which is rare we will take it to the high courts.

    STEP 2

    Our Eviction Team arrange a further date at the County Courts

    STEP 3

    A Warrant of Possession is granted, ordering the squatters to leave or face imprisonment.

    STEP 4

    Result as the Squatters are out! Happy Landlord.

    Do I have to give a squatter notice?

    No, it is advised to give a 7 day notice however we apply to court whilst the notice is in force.

    How long will it take to remove my squatter?

    Legal 4 Landlords can generally evict the squatter between 2 - 4 weeks, depending on the speed of your local court.

    Can I instruct a bailiff to remove the squatters?

    No, this will been seen as bad in court and can reduce the chance of you getting a possession order.

    If I have a Squatter who has gained entry by force, which is visible what do I do?

    Phone the Police as soon as possible and report the incident, Squatters have rights but not if there is evidence of forceful entry.
